This Refund Policy explains when and how you may receive a refund for services purchased from Stroke.Fitness LLC ("STROKE.FITNESS," "Company," "we," "us," or "our"). We are committed to transparency and compliance with Florida consumer protection laws.

1. YOUR RIGHTS UNDER FLORIDA LAW

The following refund rights are guaranteed under Florida Statutes § 501.017 and cannot be waived:

1.1 Three-Day Cancellation Right

YOU MAY CANCEL YOUR MEMBERSHIP WITHIN THREE (3) BUSINESS DAYS OF SIGNING WITHOUT PENALTY.

Timeframe: 3 business days from the date you signed your membership agreement. Business days exclude weekends and Florida state holidays.

Refund Calculation: Full refund of all amounts paid, except we may retain a daily pro-rata amount for any days you actually used the services before cancellation.

Refund Timing: Within 30 days of receiving your cancellation notice.

1.2 Facility Closure or Relocation

Eligibility: If STROKE.FITNESS goes out of business or relocates its facility more than five (5) driving miles from the original location and fails to provide an equivalent facility within 5 miles at no additional cost within 30 days.

Refund Amount: Pro-rata refund based on the unused portion of any prepaid fees.

Refund Timing: Within 30 days of facility closure or your cancellation request.

1.3 Death or Disability

Eligibility: If the member dies or becomes physically unable to use a substantial portion of the services they were using before the disability occurred.

Required Documentation:

  • For disability: Certification from a licensed physician (M.D. or D.O.)
  • For death: Death certificate

Refund Amount: Calculated by dividing the contract price by the number of weeks in the contract term and multiplying by the number of weeks remaining.

Refund Timing: Within 30 days of receiving required documentation.

2. VOLUNTARY CANCELLATION

After the 3-day cancellation period, you may cancel your membership at any time for any reason.

Notice Required: 30 days written notice before your next billing date.

Effective Date: Your membership will remain active until the end of your current paid billing period.

Refund: No refund for unused portions of the current billing period. We do not pro-rate monthly fees for voluntary cancellations.

3. 24-MONTH MONEY BACK GUARANTEE

OUR COMMITMENT: We believe in our training methods and your potential for improvement. If you follow our complete program for 24 months and experience no measurable improvement in any assessment category, we will refund 100% of your subscription fees.

3.1 Eligibility Requirements

To qualify for the Money Back Guarantee, you must meet ALL of the following requirements:

3.2 Definition of "No Progress"

"No progress" means you demonstrate no measurable improvement in ANY of the following categories when comparing your baseline (Month 0) assessment to your final (Month 24) assessment:

  • Motor Function and Strength
  • Balance and Mobility
  • Cardiovascular and Endurance
  • Functional Capacity
  • Self-Reported Function and Quality of Life

Important: Improvement in ANY ONE category constitutes "progress" and the guarantee will not apply.

3.3 Approved Absences

The following absences do not count against your compliance percentages if properly documented:

Medical Absences: Require written note from licensed physician (M.D. or D.O.) on official letterhead, specifying condition, dates, and that participation would be medically inadvisable.

Legal Absences: Require attorney letter or court documentation for mandatory legal obligations (jury duty, court appearances).

Documentation Deadline: All documentation must be submitted within 30 days of the absence.

3.4 Claim Process

Step 1: Complete your final 24-month assessment.

Step 2: Submit a written claim request within 30 days of your final assessment.

Step 3: Cooperate with our review process.

Step 4: Receive our determination in writing within 60 days.

3.5 Refund Amount

If approved: 100% of all monthly subscription fees paid during the 24-month qualifying period.

NOT included in refund:

  • Initial enrollment or registration fees
  • Charges for additional services (including medically supervised training)
  • Products or equipment purchased separately
  • Late fees or service charges
  • Payments made beyond the 24-month qualifying period

3.6 Disqualifying Factors

The Money Back Guarantee is void if:

  • You fail to meet any eligibility requirement
  • You provide false or misleading information
  • You are terminated for violating facility rules or membership agreement
  • External factors cause decline in function (subsequent stroke, new medical condition, accident, discontinuation of prescribed medical treatments)
  • You demonstrate measurable progress in any assessment category

4. INTENSIVE TRAINING PROGRAMS

For one-time intensive training programs or packages:

3-Day Cancellation: Same as monthly subscriptions—you may cancel within 3 business days for a full refund minus any services already used.

After 3 Days: Intensive programs are generally non-refundable after the 3-day period, except as required by Florida law (death, disability, facility closure).

Rescheduling: We may allow rescheduling of unused sessions at our discretion. Contact us at [email protected] to discuss your situation.

5. HOW TO REQUEST A REFUND

All refund requests must be submitted in writing:

In Person: At our facility with written acknowledgment

Your request should include:

  • Your full name and contact information
  • Membership or account number (if known)
  • Reason for refund request
  • Any required documentation (physician letter, death certificate, etc.)
  • Date of original purchase/enrollment

6. REFUND PROCESSING

Processing Time: All approved refunds will be issued within 30 days of approval (90 days for Money Back Guarantee claims).

Refund Method: Refunds will be issued to the original payment method used. If that method is no longer available, we will issue a company check.

Confirmation: You will receive written confirmation when your refund has been processed.

7. DISPUTES

If you disagree with our refund determination, you may:

  1.  Contact us directly to discuss your concerns
  2.  Request an independent third-party review (for Money Back Guarantee claims)
